Is Standard right for you?

For applicants who want help filing and a fee tied to the result.

Standard adds filing assistance and tracking to publication to a professionally drafted response, and puts two-thirds of the fee behind the USPTO's approval.

Standard fits if you…

  • received a Section 2(d) likelihood-of-confusion refusal
  • want guidance through filing from your own USPTO.gov account
  • want most of the fee to depend on approval, not on effort
  • are a U.S.-domiciled applicant filing for yourself or your business

Choose another package if you…

  • want a second response already included: Standard Plus, $1,750 if approved
  • would rather file yourself for a lower flat fee: Basic, $700
  • aren't sure the refusal can be beaten yet: start with the $25 TRACE™ Report, credited toward Standard

What you get

Everything from the first draft to publication.

Not a template with your mark typed in. Each response is drafted against your refusal, your cited registrations and the arguments the Board actually accepts, and then we stay with the file.

01

Your TRACE™ Report

The diagnostic behind the draft: your Confusion Index, the factors in your favor, and the gaps the response must close. Already have one? Your $25 is credited.

02

A custom response draft

A complete response that takes the examiner's reasoning apart factor by factor, with precedent, evidence exhibits and unlimited revisions until you approve it.

03

Filing assistance

We guide you through submitting the response from your own USPTO.gov account. You review and sign it; we never log in with your credentials.

04

Tracking to publication

After filing, we follow the application and keep you informed until the examiner's decision and approval for publication.

05

A fee tied to approval

$1,000 of the fee is due only if the USPTO approves your mark for publication. If the refusal is maintained and made final, it is not owed.

06

A second response, if needed

If the examiner pushes back again, add a second response for a flat $500, and the $1,000 success fee is waived in its entirety.

Refusals the Board reversed

Refused by the examiner. Reversed by the Board.

Each applicant was refused by an examining attorney, appealed, and won. Each won on a different argument, and each is an argument your Standard response can make.

Why the Board reversed

The services were identical, but the Board found the marks different in sound, appearance, meaning and overall impression. Roofing is a complex, multi-step purchase, so buyers take care.

What it means for your response

Rhyming lead words are not the whole comparison. Show how the full marks differ and how carefully your buyers choose.

Questions

Before you start.

Anything else? Email info@trademarkscrivener.com.

When exactly is the success fee due?

Only if your mark is approved for publication, following withdrawal of the Section 2(d) refusal our response addressed. If the refusal is maintained and made final, no success fee is owed.

Who files the response?

You do, from your own USPTO.gov account, with our step-by-step guidance. You review and sign every filing; we never log in with your credentials. That keeps you in full control as the applicant of record.

My deadline is close. Is there time?

Usually. Your draft arrives 5 to 7 business days after the deposit, once we have your materials. Tell us your deadline when you start, and we will flag it right away if it is too tight.

Are you a law firm?

No. Trademark Scrivener is an independent trademark administrator and diagnostic service. We do not give legal advice or act as your attorney, and we do not represent you before the TTAB.

Can you guarantee the refusal will be withdrawn?

No one can. The examining attorney decides. That is why most of the fee is tied to the USPTO's decision.

Is the deposit refundable?

No. The $250 deposit is non-refundable once paid, because work starts immediately. The full refund and cancellation terms are in our Terms of Service.

Who can use Standard?

Applicants domiciled in the United States. USPTO rules require foreign-domiciled applicants to use a U.S.-licensed attorney, so we cannot prepare their responses.

Your deadline is already running

Answer the refusal with a response built to win it.

Reserve Standard today for $250. Your draft is in your hands within 5 to 7 business days, and the largest part of the fee waits for the result.
