Two rounds against the refusal. One flat fee.

  • $900 flat for two responses
  • Unlimited revisions
  • You stay the applicant of record

Is Basic Plus right for you?

For refusals that may take more than one round.

Basic Plus is for applicants who will file the response themselves but want the second round covered from the start, for less than adding it later.

Basic Plus fits if you…

  • received a Section 2(d) likelihood-of-confusion refusal
  • are comfortable filing from your own USPTO.gov account with clear instructions
  • want a second response, or a request for reconsideration, already paid for
  • are a U.S.-domiciled applicant filing for yourself or your business

Choose another package if you…

  • only want one round, at the lowest cost: Basic, $700
  • want two responses plus help filing and tracking to publication, with most of the fee due only on approval: Standard Plus, $1,750 if approved
  • aren't sure the refusal can be beaten yet: start with the $25 TRACE™ Report, credited toward Basic Plus

What you get

Everything you need to answer the examiner, in one package.

Not a template with your mark typed in. Each response is drafted against your refusal, your cited registrations and the arguments the Board actually accepts.

01

Your TRACE™ Report

The diagnostic behind the draft: your Confusion Index, the factors in your favor, and the gaps the response must close. Already have one? Your $25 is credited.

02

A custom response draft

A complete, ready-to-sign response that takes the examiner's reasoning apart factor by factor, with precedent and record citations.

03

An evidence plan

What to attach and why: third-party registrations, marketplace evidence and dictionary definitions, organized as exhibits.

04

Related amendments

Where narrowing your goods or services would help, we propose the wording. Nothing changes without your written approval.

05

A second response, included

If the examiner maintains the refusal, we draft your second response or a request for reconsideration at no extra fee. Unlimited revisions on both.

06

Step-by-step filing instructions

Screen-by-screen guidance for submitting the response and exhibits from your own USPTO.gov account, well before your deadline.

Refusals the Board reversed

Refused, then reversed. Persistence pays.

Each of these applicants was refused, kept going, and won on appeal. With Basic Plus, a second round is already part of the plan, so one setback never ends the fight.

Refusal reversedDifferent meaning
Applicant's markBRECKIN ANKLESBasketball apparel
Cited registrationBREKENS BShirts, hats, tops and pants

Why the Board reversed

The clothing overlapped, but the marks did not. To basketball buyers, BRECKIN ANKLES calls up the slang “breaking ankles,” while BREKENS B reads as a name.

What it means for your response

Marks that look alike on paper can mean different things to real buyers. Show what your mark means in your market.

Questions

Before you start.

Anything else? Email info@trademarkscrivener.com.

What do I need to send you?

Your application serial number and the Office Action. We pull the cited registrations ourselves. If you have evidence of how you sell, such as your website, packaging or customers, send that too.

My deadline is close. Is there time?

Usually. Your draft arrives 5 to 7 business days after the deposit, once we have your materials. Tell us your deadline when you start, and we will flag it right away if it is too tight.

Are you a law firm?

No. Trademark Scrivener is an independent trademark administrator and diagnostic service. We do not give legal advice or act as your attorney. You remain the applicant of record, approve every word and file the response yourself.

Can you guarantee the refusal will be withdrawn?

No one can. The examining attorney decides. Be wary of anyone who promises otherwise. Your TRACE™ Report shows where your case really stands before you commit.

What if the examiner maintains the refusal?

Your second response is included. We draft it, or a request for reconsideration, at no extra fee, with the same unlimited revisions.

Is the deposit refundable?

No. The $200 deposit is non-refundable once paid, because work starts immediately. The full refund and cancellation terms are in our Terms of Service.

Who can use Basic Plus?

Applicants domiciled in the United States. USPTO rules require foreign-domiciled applicants to use a U.S.-licensed attorney, so we cannot prepare their responses.
