  • $2,000 only on registration
  • Strategic Refiling Guarantee
  • Every filing to registration

Is Premium Plus right for you?

The widest safety net we offer.

Premium Plus covers every filing through registration and adds the Strategic Refiling Guarantee. The success fee is tied to registration itself, not to an earlier milestone.

Premium Plus fits if you…

  • received a Section 2(d) likelihood-of-confusion refusal
  • want the success fee due only on registration
  • want a second chance if a final refusal can't be overcome
  • are a U.S.-domiciled applicant filing for yourself or your business

Choose another package if you…

  • are satisfied with approval for publication as the milestone: Premium, $2,500 if approved
  • want two responses and filing help at a lower total: Standard Plus, $1,750 if approved
  • aren't sure the refusal can be beaten yet: start with the $25 TRACE™ Report, credited toward Premium Plus

What you get

Everything from the first draft to the registration certificate.

Not a template with your mark typed in. Each response is drafted against your refusal, your cited registrations and the arguments the Board actually accepts, and then we stay with the file.

01

Your TRACE™ Report

The diagnostic behind the draft: your Confusion Index, the factors in your favor, and the gaps the response must close. Already have one? Your $25 is credited.

02

A custom response draft

A complete response that takes the examiner's reasoning apart factor by factor, with precedent, evidence exhibits and unlimited revisions until you approve it.

03

Filing assistance

We guide you through submitting the response from your own USPTO.gov account. You review and sign it; we never log in with your credentials.

04

Two responses, every filing

A second response is included, and we handle every filing through registration, including any Statement of Use.

05

Strategic Refiling Guarantee

If a final Section 2(d) refusal can't be overcome, we develop a new strategy and prepare a new application for the same mark at no service fee.

06

Paid on registration

After the $1,000 deposit, the $2,000 balance is due only when your mark registers. Nothing is due on draft delivery.

Refusals the Board reversed

Three ways a refusal was overcome.

Each applicant was refused by an examining attorney, appealed, and won. Each won on a different argument, and each is an argument your Premium Plus response can make.

Why the Board reversed

The marks were similar and some services identical, but the applicant and registrant had a settlement agreement. The Board gave the owners' own judgment substantial weight.

What it means for your response

Sometimes the strongest evidence is the other owner's agreement. Consent can outweigh close marks.

From non-precedential decisions of the Trademark Trial and Appeal Board, 2025–2026. Every case turns on its own record.

Questions

Before you start.

Anything else? Email info@trademarkscrivener.com.

When exactly is the success fee due?

Only when your mark registers. If the refusal is maintained and made final, no success fee is owed.

Who files the response?

You do, from your own USPTO.gov account, with our step-by-step guidance. You review and sign every filing; we never log in with your credentials. That keeps you in full control as the applicant of record.

My deadline is close. Is there time?

Usually. Your draft arrives 5 to 7 business days after the deposit, once we have your materials. Tell us your deadline when you start, and we will flag it right away if it is too tight.

Are you a law firm?

No. Trademark Scrivener is an independent trademark administrator and diagnostic service. We do not give legal advice or act as your attorney, and we do not represent you before the TTAB.

Can you guarantee the refusal will be withdrawn?

No one can. The examining attorney decides. The Strategic Refiling Guarantee gives you a second chance, not a promise of registration.

Is the deposit refundable?

No. The $1,000 deposit is non-refundable once paid, because work starts immediately. The full refund and cancellation terms are in our Terms of Service.

Who can use Premium Plus?

Applicants domiciled in the United States. USPTO rules require foreign-domiciled applicants to use a U.S.-licensed attorney, so we cannot prepare their responses.

Your deadline is already running

Answer the refusal with a response built to win it.

Reserve Premium Plus today for $1,000. Your draft is in your hands within 5 to 7 business days, and the largest part of the fee waits for the result.
