On the Self-Filing track (Basic, Basic Plus), Trademark Scrivener's engagement ends once we deliver your highly-customized, watermarked response draft with comprehensive self-filing instructions. You are solely responsible for uploading the arguments to the USPTO portal, paying the government fees, submitting the response, and tracking your application's status. On the Assisted tracks (Standard, Standard Plus, Premium, Premium Plus), we provide clerical filing assistance by helping you upload the response directly to the USPTO portal, and we actively track and monitor your application's progress inside the administrative system.
Our single-response packages (Basic, Standard) cover the preparation of a single response to the initial USPTO Office Action. If the USPTO issues a subsequent refusal after the initial submission, our "Plus" versions (Basic Plus, Standard Plus) and Premium tracks (Premium, Premium Plus) cover up to two complete response drafts at no extra service fee. For the Standard Package, if a second response is required, you can choose to purchase a second response draft for a flat $500, in which case the original $1,000 success-contingent fee is completely waived.
Active tracking "To Publication" (Standard, Standard Plus) means we cleryically file your response and monitor your application through the USPTO administrative database until the Examining Attorney officially withdraws the likelihood of confusion refusal and approves your mark to proceed to publication in the Official Gazette. Tracking "To Registration" (Premium, Premium Plus) extends our administrative support past the publication window. We monitor your mark through the post-publication opposition period and provide active tracking all the way until the USPTO officially issues and delivers your physical trademark registration certificate.
If you choose the Premium Plus package and the USPTO ultimately issues a final refusal that cannot be overcome, our Strategic Refiling Guarantee is activated. Trademark Scrivener will engineer a completely new filing strategy and draft a brand-new trademark application at a **$0 service fee** (you only cover separate, standard USPTO government filing fees). We will then draft all necessary responses and cleryically track your new application all the way to a successful final registration.
